1. Scope

This Billing / Refund / Cancellation Policy applies to fees, payments, cancellations, renewals, refunds, and billing disputes for the Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

2. Plans and Fees

Current pricing, plan names, plan limits, included usage, and any usage-based charges are shown on the applicable pricing page, checkout page, invoice, Order, or order form.

You are responsible for all fees incurred through your Account.

3. No Free Trial

AnswerKit does not offer a free trial for the initial launch unless we expressly state otherwise in writing.

4. Payment Processing

Payments are processed through Stripe. We do not store full payment card numbers unless expressly stated; payment card processing is handled by the payment processor.

5. Recurring Billing

Unless an Order states otherwise, subscriptions renew automatically on a monthly basis until canceled.

By purchasing a subscription, you authorize us and our payment processor to charge your payment method for recurring fees, usage-based fees, agreed overages, taxes, and other amounts due.

6. Usage-Based Fees, Overage Fees, and Plan Limits

Your plan may include usage limits. Usage beyond plan limits may result in throttling, suspension, or a requirement to upgrade.

AnswerKit will not impose automatic overage charges unless overage pricing is clearly displayed and agreed. If overage fees apply, they will be billed on the next invoice unless the applicable Order, checkout page, invoice, or pricing page states otherwise.

Telephony, AI processing, transfer, number, and carrier-related costs may vary. We may limit usage that creates operational, telecom, security, or cost risk.

7. Taxes

Fees do not include taxes unless stated otherwise. You are responsible for applicable taxes, duties, and similar government charges, except taxes based on our income.

8. Failed Payments

If payment fails, we may retry the payment method and request updated payment information. We provide a 7-day grace period after a failed payment before we suspend service for non-payment, unless we reasonably believe immediate action is needed for fraud, security, legal, telecom, provider, or operational risk.

After the 7-day grace period, we reserve the right to suspend, limit, or terminate the Service until amounts due are paid. You remain responsible for unpaid amounts.

9. Cancellation

You may cancel your subscription through the dashboard or by emailing answerkit@pm.me.

Cancellation takes effect at the end of the then-current paid billing period. The Service remains active through the end of that period unless suspended or terminated under the Terms.

10. Refunds

Refunds are not provided by default.

We may provide refunds only if:

  1. Required by law.
  2. Expressly stated in an Order.
  3. AnswerKit chooses, in its sole discretion, to provide a credit or refund in writing.

No refund is provided for unused time, partial billing periods, failed transfers, inaccurate AI Output, service interruptions, customer misconfiguration, telecom provider issues, or cancellation before the end of a billing period, unless required by law or expressly agreed in writing.

11. Upgrades, Downgrades, and Plan Changes

Unless an Order states otherwise:

  1. Upgrades may take effect immediately, with prorated charges if applicable.
  2. Downgrades take effect at the start of the next billing period.
  3. Feature access may change when you downgrade.
  4. Usage above the downgraded plan’s limits may be billed as agreed overage, throttled, suspended, or require an upgrade.

12. Pricing Changes

We may change pricing by giving notice through the Service, by email, on the pricing page, or by other reasonable means.

Unless otherwise stated, pricing changes apply at the next renewal.

13. Chargebacks and Billing Disputes

If you believe a charge is incorrect, contact answerkit@pm.me within 30 days after the charge or invoice date so we can try to resolve the issue. This notice period does not limit any non-waivable rights you may have under applicable law.

If you initiate an improper chargeback, we may suspend or terminate the Account, recover amounts due, and require payment by another method.

14. Account Suspension for Billing Issues

We may suspend or limit the Service for overdue payments, failed payment methods, suspected fraud, chargebacks, or billing abuse. Suspension does not relieve you of payment obligations.

15. Data After Cancellation

After cancellation or termination, Customer Data may be retained or deleted according to the Privacy Policy, DPA, and retention schedule.

After account deletion, Account data, business profile information, transcripts, and summaries are deleted or anonymized within 60 days, except for legal, security, billing, tax, backup, fraud-prevention, dispute, and compliance records. Backup copies may persist for up to 90 days according to backup rotation.
